Monster Auction, LLC at its sole discretion, may ban from further use any buyer or seller which Monster Auction, LLC believes to have in any way misrepresented itself or any item selling, failed to abide by the terms, or conducted any improper auction behavior as determined solely by Monster Auction, LLC. Any seller who misrepresented their items and any buyer who improperly fails to carry through with a purchase will be banned from any further use and may be subject to additional legal actions.

Article 1: ELIGIBILITY OF MEMBERSHIP: This auction site, storageauctionsonline.com, is only available to people who are legally able to form binding contracts. People who are under the age of 18 are not eligible for membership due to state laws concerning the age of majority. If you do not meet these requirements, you are not eligible to use these auction services.

Article 2: Warranties: Monster Auction, LLC is providing Internet auction services. Monster Auction, LLC cannot guarantee the authenticity and quality of a said product, furthermore, Monster Auction, LLC is not responsible for typographical errors, misprints, loss of merchandise/money, damage or failure of equipment. No bids can be withdrawn after being placed. BUYER agrees to all terms mentioned within this document and agrees that these terms may only be revised in writing, signed by an authorized representative of Monster Auction, LLC. BUYER understands that any description given in the catalog or written on the equipment is not guaranteed. All information and descriptions contained in advertising this sale are believed correct, however Monster Auction, LLC assumes no responsibility for errors or omissions.

Article 3: Selling:

Article 3a: Selling: As a user, you may sell merchandise or foreclosed storage units and other foreclosed items using storageauctionsonline.com.

Article 3b: Binding Contract: As a seller you agree to sell the merchandise for the ending bid value, unless there is a reserve and the reserve was not met. If the reserve is met you must sell the said merchandise for the final bid value. By listing an auction you agree that this is a binding contract and you will follow through with the transaction.

Article 3c: End Auction Early: Foreclosed merchandise can be paid for up to the time of the auction. A seller may have to remove an item or storage unit auction from the web site because the owners paid their outstanding debt and the merchandise is no longer available for auction.

Article 4: Bidding:

Article 4a: Bidding: As a user, you may bid on products using storageauctionsonline.com.

Article 4b: Binding Contract: As a bidder you know that placing a bid is a binding contract between you and the seller and a bid cannot be retracted unless by mistake of seller, of typographical error, or other error, due to human error on the seller's part. Once you place a bid, and if you win, you will be obligated to buy the product at the said price you indicated as your bid. Placing a bid on this auction site, winning, then not paying for the product is illegal in most states, resulting in possible prosecution.

Article 5: NOTICE OF CHARGES:

Article 5a: Listing fees: It is free to list your auctions on www.storageauctionsonline.com. You only pay a final value fee if the item or storage unit sells. Go to the site fees section on the web site for detailed fees. List your items or advertisement free in the want ads section. You can also set up store front on our web site.

Article 5b: Storage unit cleaning fee: Foreclosed storage units must be completely cleaned out when purchased at auction. You may be charged a cleaning fee if you don’t clean out the storage unit you purchase. You may also lose the right to bid if the storage unit isn’t cleaned out (we will suspend your account for this reason).

Article 6: Removal and Failure to Remove: All purchases must be removed from the auction site without damaging any property and within the time announced or posted. All costs, responsibility and risk of such removal shall be borne by buyer and, in every case; buyer will use prudence and care in such removal. If for any reason buyers fail to remove any of buyer purchases within the time specified, Sellers shall have the right, but not the obligation, in its sole discretion, to recall, discard remove or store said purchase at buyers sole risk and expense, without waiving any rights that the seller may have against buyer. After said time and date set by the seller items will be considered abandoned if not picked up within that time period. Storage or cleaning charges will be the responsibility of the buyer.

Article 7: Shipping & Handling: Shipping is at the sole discretion of the seller.

Article 8: Auto extend bidding feature - This feature does NOT allow an item to sell at the end of the auction until there is 5 minutes of bidding inactivity. Example - An item is bid on at 7:59 pm. An auction is scheduled to close at 8:00 pm. When this bid is placed the ending time will automatically extend to 8:05 pm. If another bid is place at 8:03, the auction will extend until 8:10 pm. Therefore, always allowing a bidder time to up his or her bid.. If no bids are placed once the additional time has elapsed, the auction will conclude.

Article 9: Right to Terminate Purchase: Monster Auction, LLC reserves the right to terminate any sale at its sole discretion and shall return any unearned fees and cost associated with a terminated sale.

Article 10: Consent to Suit in Michigan: In the event of legal proceedings arising from this contract or from the auction in connection therewith. Buyer consents to being subject to the personal jurisdiction of the courts of the State of Michigan. Buyer also agrees that venue shall be in Genesee County, Michigan.

Article 11: Indemnification: The BUYER expressly agrees to indemnify and save Monster Auction, LLC harmless from and against all claims, losses, expenses, damage or liability, (including, but not limited to, attorney's fees), directly or indirectly caused by or resulting from an act, including the negligent acts or omissions of Monster Auction, LLC or omissions of Monster Auction, LLC or anyone acting in his/her behalf in connection with or arising from an auction.

Article 12: This web-site is intended to be a friendly, enjoyable and useful experience, but as with anything concerning any kind of transactions there are risks involved and we strongly advise you to understand all of these terms before joining. If you spot a listing that you feel is violating the general terms and conditions of this web-site as stated below please let us know by contacting us.

Article 13: Rights to Suspend or Terminate.
You agree that this web-site, in its own discretion, may terminate any auction or use of the service immediately and without notice if (a) We believe that you are not abiding by the general rules of this web-site
(b) You have repeatedly broken a certain term (c) You have listed a suspicious item (d) We believe you to be a non paying bidder. In most cases when we suspect foul play we will suspend your account/listing whilst we investigate further. If our investigation is conclusive then your account with us will be terminated.

Article 14: Your Conduct.
You are solely responsible for the contents of your actions through this web-site. You must ensure that your participation in the selling or buying of items does not violate any applicable laws or regulations. By this we mean that you must check that you entitled to sell or buy the relevant item and that you are not prohibited from doing so by any law or regulation.
You must not transmit through the service any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material. You must also not transmit any material that encourages conduct that could constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law or regulation.

Article 15: General Terms.
This site acts as the window for sellers to conduct auctions and for bidders to bid on sellers' auctions. We are not involved in the actual transaction between buyers and sellers. As a result, we have no control over the quality, safety or legality of the items listed the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to buy items. We cannot and do not control whether or not sellers will complete the sale of items they offer or buyers will complete the purchases of items they have bid on.
In addition, note that there are risks of dealing with foreign nationals, underage persons or people acting under false pretence.
This Web-site shall not be responsible for any items sold by Auction, for any damage to items during transit or during the inspection period, nor for misrepresentations and/or breaches of contract by either buyer and/or seller. This web-site shall not be responsible for the cost of procurement of substitute goods or any losses resulting form any goods purchased or obtained.
This web-site assumes no liability for the content of the listings.
However if you fall victim of a fraudulent transaction we will assist you as much as we can.
